Trademark Registration in Azerbaijan

The registration procedures for trademarks, patents, copyrights and IP in general are regulated by the intellectual property legislation of Azerbaijan.

What can be registered as a trademark™?

​

word, phrase, symbol, design, or a combination that identifies a product or service from a particular source and distinguishes it from others can be registered as trademarks.

 

In order to have a mark to be duly registered in Azerbaijan, it must be unique and distinct to identify the entity in the marketplace.

Documents required for a trademark registration:

​

  • Application form;

  • Duly attested PoA in order to represent your entity;

  • Incorporation documents of the company (for non-resident companies, incorporation documents should be duly attested at the consulate of Azerbaijan);

  • If required, a document confirming the originality of the trademark;

  • Details of the applicant (name, address, etc);

  • Goods or services classification;

  • Color specification;

  • Transliteration and translation.

The processing time for trademark registration in Azerbaijan ranges from 5 to 8 months, depending on the application flow, and the preliminary examination takes 2 months.

​

Upon a trademark registration, the authorities issue a Certificate of Registration, which confirms your exclusive rights to the trademark in question and grants you the authority to prevent unauthorized usage.

​

Trademark in Azerbaijan is valid for ten years from the filing date. A trademark may be renewed for successive periods of 10 years within 12 months before the expiration date.

 

Please note that as per the local legislation, similar or identical designations with the trademarks previously registered or applied for registration in respect of similar goods and/or services cannot be registered, however, it is possible to order a professional trademark search to determine whether there are any similar or identical registered trademarks or filed trademark applications.
